Moldova's Justice Minister says Parliament should be dissolved

The current Parliament must be disbanded because there exists not a single legal way to avoid an early parliamentary election, believes Moldovan Minister of Justice, First Deputy Chairman of the Liberal Democratic Party Alexandru Tanase.

Speaking over the Moldova-1 public television channel last Friday night, he stated that an early election is inevitable for one simple reason - because the current legislation says so, and he does not quite understand why the governing Alliance for European Integration [with his Liberal Democratic Party being the largest constituent force in it] is doing its utmost to prevent the polls.

"There exists law and Constitution, stipulating clearly that in case of a failure to elect president, the parliament is dissolved. If so, there is no legal ground for avoiding an early election", said Alexandru Tanase.

One of the nation's prominent-most lawyers is quite skeptical about the dream to hold a constitutional referendum before June 16.

He said, "Amending of the Constitution and holding of an early election are two different questions, which should not be tackled together. I've got an impression that somebody is trying to hold his parliamentary mandate as long as only possible - like President of Belarus Alexander Lukashenko does. At any rate, the Constitution has to be amended, but this can't and should not be done in two or four months. This is too important a document to be amended hastily, on the following morning, merely out of political interests".

In his belief, a new Constitution would require approximately 2 years of persistent everyday work, not shorter. He remarked, "The Venice Commission delegation came to Chisinau recently on God knows whose invitation. While in Chisinau, the guests could not see the draft of a new Constitution because it was not ready yet by that moment, so the Commission could not indeed read it and speak out its opinion. One day, I was amused to read in papers that I was a member of the Commission for Constitutional Reform, which had been drafting a new Main Law for several days by that moment".

Infotag's dossier: The Venice Commission of the Council of Europe recommended Moldova to amend only Article 78 in the Constitution in a way to stipulate electing of president in parliament by a simple majority of deputies. The amendment work over, this Parliament ought to be dissolved. This year, Venice Commission representatives have already visited Moldova twice on the invitation of Acting president and Commission for Constitutional Reform chairman Mihai Ghimpu.
