Moldovan top court rules that cabinet members should be suspended from office during election campaign
The Constitutional Court (CC) has ruled that the government members who run for MP seats should be suspended from office during the election campaign. On 28 October, the government asked the CC to give its opinion on the constitutionality of the article 13 from the Election Code, which clearly sees the suspension from office of the cabinet members.
The government reasons that the continuity of the power is not observed by the suspension from office of the ministers who put up their candidacies on party lists, just as it is required in the Constitution. The head of the CC press service, Dumitru Tira, has told MOLDPRES that the Constitutional Court found out that the article 13 from the Election Code is constitutional.
On 21 October, the Court decided to cease considering a government's request, on grounds that Prime Minister Vlad Filat would have no right to notify the Constitutional Court. On 28 October, the cabinet notified the Court on the same topic, by government decision this time.
