Moldova undertakes actions on judicial reforms

The government during the first 100-day activity undertook reformation actions in terms of structure and procedure in justice, such as the election of new members of the Superior Council of Magistrates by the Judges General Assembly, launch of the process of liberalisation of the system of judicial decisions' fulfillment, adoption of the reform of the Bar's Institution.

Prime Minister Vlad Filat made a statement to this effect in a report on the government's activity in the first 100 days. The report says that the edifying of a state based on the rule of law, ensuring the observance of the principle of separation and independence of powers, independence of justice were priorities on the government's agenda in the first 100 days, and will further be.

Thus, to ensure the independent activity of the Superior Council of Magistrates, the Judges' General Assembly elected new members in the judicial self-administration body. The Justice Ministry elaborated a draft law on the shift of the judicial administration department from the subordination to the Justice Ministry to the one of the Superior Council of Magistrates.

The government also launched the process of liberalisation of the judicial decisions' fulfillment system, so as to settle the problems of non-execution or delayed execution of judicial decisions, which affect citizens' confidence in the justice act and the quality of the business environment in Moldova. Thus, the cabinet of ministers approved a draft law on the judicial executors on 24 December 2009. The draft sees the establishment of a system of private judicial executors, creation of an area of free competition and motivation of judicial executors, guaranteeing citizens' access to the services provided by the executors.

Also on 24 December 2009, the government approved the Bar's Institution's Reform in concert with representatives of the Moldovan Bar Association, National Council of State Guaranteed Juridical Assistance, associated office of lawyers, Public Lawyers, and the Law Programme of the Soros-Moldova Foundation, Norwegian Mission of Rule of Law Advisers to Moldova (NORLAM). The reform aims at consolidating the bar's institution and changing the general vision on the role of the Bar and organisation of the profession of lawyer, the report also says.
