Constitutional court to consider government's inquiry on November 9
The Moldovan Constitutional Court will urgently consider, on November 9, the Government's inquiry concerning the legitimacy of suspending the offices of deputy premiers and ministers for election campaign period. The Cabinet of Ministers approved the inquiry and sent it to the Court on October 28.
As was already reported by Infotag, initially the Court received such inquiry from Prime Minister Vlad Filat, but declined it on October 21 saying that the Premier was not eligible to do that.
CC Judge Victor Puscas stated then that the Premier has the right to sign such inquiry only if there exists a corresponding Resolution of the Government, and said the Court would come back to considering that problem if the Government sends in such Resolution.
According to the legislation in force, deputy premiers and ministers of government must suspend their offices for election campaign period in case they have been included into party tickets and take part in electoral canvassing.
Filat presumes this rule in the Electoral Code is at odds with Article 103 of the Constitution, according to which government performs its duties until the recognition of the election of a new parliament.
In the run-up to the November 28 early parliamentary elections, as many as 18 deputy premiers and ministers the runners for parliament have suspended their governmental activities. Filat says this may paralyze governmental activities.
